GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale govern all sales concluded on the website https://www.buschcollectibles.com between:

hereinafter « the Seller »,

and any person making a purchase on the website, hereinafter « the Buyer ».

They are accessible at all times on the website and prevail over any other terms. Acceptance, given by ticking a checkbox before payment is validated, is a condition of the order.

Sales made on third-party marketplaces (eBay, Delcampe, HipStamp, Todocoleccion) are governed first and foremost by the terms of those platforms, supplemented by these terms in so far as they do not contradict them.

The Seller reserves the right to amend these terms at any time. The terms applicable to an order are those in force on the date the order is validated. The products offered are, for the most part, unique collectors' items or items available in very limited quantity: postage stamps, deluxe proofs, artist's proofs, imperforate issues, sheets, philatelic documents and collectibles, mint or used, historic or modern.

In accordance with decree no. 81-255 of 15 March 1981 on the suppression of fraud in transactions involving collectors' items, each product page states:

• the exact nature and designation of the item, its country and year of issue;
• the applicable catalogue references (Yvert & Tellier, Michel, Scott, as the case may be);
• the condition and any defects (hinge, crease, foxing, perforation, gum, oxidation);
• where applicable, the existence of an expert certificate and the name of its author.

The photographs constitute the primary descriptive element and are binding on the Seller. Slight variations in colour rendering caused by screens and shooting conditions do not constitute a lack of conformity.

As the items are mostly unique, sales are concluded in the order in which payments are received: adding an item to the basket does not reserve it. Prices are stated in euros, all taxes included, excluding delivery costs. The latter are specified before the order is validated, according to the destination and the shipping method chosen.

VAT scheme. Sales of second-hand goods and collectors' items fall under the special margin scheme provided for by article 297 A of the French General Tax Code. Invoices bear the statement: « Régime particulier — Biens d'occasion / Objets de collection. TVA non récupérable par l'acquéreur. » No VAT is invoiced separately and no deduction is available to the Buyer.

Certain intra-Community or export sales may fall under a different scheme; the corresponding statements then appear on the invoice.

Price reductions. Where a reduction is announced, the reference price displayed is the lowest price applied during the thirty days preceding the announcement (art. L. 112-1-1 of the French Consumer Code).

The Seller reserves the right to amend its prices at any time. The applicable price is the one displayed at the time the order is validated. The order is concluded once confirmed by double click and payment has been collected. An acknowledgement of receipt is sent by e-mail, including the order summary and a reminder of these terms.

It is for the Buyer to check the accuracy of the information entered, in particular the delivery address, before validation. Where an error is reported before dispatch, the Seller will endeavour to correct it.

The Seller reserves the right to refuse any order from a Buyer with whom a payment dispute is pending, or any order that is abnormal or manifestly fraudulent. Accepted means of payment: bank card (via Stripe), PayPal, SEPA transfer and cheque drawn on a French bank.

Orders paid by cheque are dispatched only once the cheque has actually cleared, which may extend the delivery time by several working days.

Card payments are subject to strong customer authentication in accordance with the PSD2 directive. Bank details are processed exclusively by the payment provider and are at no point stored by the Seller.

Dispatch takes place only once payment has actually been collected. If payment is rejected, the order is cancelled automatically.

Business Unless otherwise agreed in writing, payment is due on receipt of invoice. Any delay automatically gives rise, without prior formal notice, to penalties calculated at three times the statutory interest rate, together with a fixed recovery cost indemnity of €40 (art. L. 441-10 of the French Commercial Code), without prejudice to any justified additional amount.

Retention of title. Delivered goods remain the property of the Seller until their price has been paid in full. Areas served: worldwide.
Shipping methods: La Poste (tracked letter, Colissimo), Mondial Relay, DHL, FedEx and UPS depending on the destination and the order value.

Orders are dispatched within 5 working days of payment being collected. The indicative delivery time is communicated before validation. In any event, delivery takes place no later than thirty days after the contract is concluded, unless otherwise agreed.

Consumer Where this period is exceeded, the Buyer may require the Seller to deliver within a further reasonable period, then terminate the contract if delivery does not take place within that new period (art. L. 216-6 of the French Consumer Code). Sums paid are then refunded within fourteen days of termination.

Transfer of risk.
Consumer Risk passes at the moment the goods are physically handed over to the Buyer or to a third party designated by them, other than the carrier proposed by the Seller (art. L. 216-4 of the French Consumer Code).
Business Risk passes as soon as the goods are handed over to the carrier.

Anomalies on receipt. Any parcel that is damaged, opened or with missing contents must be the subject of written, precise and detailed reservations made to the carrier at the time of delivery, and reported to the Seller at contact@buschcollectibles.com within 3 working days, with photographs of the parcel and its contents.

Shipments outside the European Union. Customs duties, import taxes and clearance fees are borne exclusively by the Buyer, who alone is responsible for complying with the import regulations applicable in their country. Refusal of a parcel for non-payment of these charges does not give rise to any refund of shipping costs. Consumer The consumer Buyer has fourteen days from receipt of the goods to exercise their right of withdrawal, without having to give reasons or bear any cost other than that of return. Withdrawal is exercised by any unambiguous statement sent to contact@buschcollectibles.com, or by means of the withdrawal form made available on the website, a template of which also appears in the appendix hereto. Use of this form is not mandatory: any other statement unambiguously expressing the intention to withdraw is admissible. The Seller acknowledges receipt without delay by e-mail, on a durable medium.

The goods must be returned within fourteen days of the notification, in their original condition, complete and undamaged, in protective packaging suited to their fragility (protective sleeve, rigid backing, tracked shipping). Return costs are borne by the Buyer. Given the value and fragility of the items, tracked and insured shipping is strongly recommended: the burden of proving the return lies with the Buyer. The refund is in full, including outbound delivery costs at the standard delivery rate, and is made within fourteen days of recovery of the goods or of the Buyer providing proof of their dispatch, whichever occurs first. It is made using the same means of payment as that used for the order. The Buyer may be held liable for any depreciation resulting from handling other than that necessary to establish the nature, characteristics and good condition of the goods.

The following are in particular liable to cause depreciation: removal or alteration of the gum, application or removal of a hinge, a crease, a fingerprint or moisture mark, removal of a presentation backing, opening of an expert seal, or any action altering the condition described at the time of sale. The right of withdrawal does not apply to goods made to the Buyer's specifications or clearly personalised (art. L. 221-28 of the French Consumer Code). Consumer

The consumer has two years from delivery of the goods to obtain the benefit of the legal guarantee of conformity should a lack of conformity appear. During this period, the consumer need only establish the existence of the lack of conformity, not the date on which it appeared. For second-hand goods, this presumption period is reduced to twelve months (art. L. 217-7 of the French Consumer Code).

The legal guarantee of conformity entails an obligation to supply all necessary accessories and instructions. It gives the right to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience to the consumer. If the goods are repaired under this guarantee, the legal guarantee is extended by six months. Where the consumer requests repair but the seller imposes replacement, the legal guarantee runs again for two years from the replacement.

The consumer may obtain a price reduction while keeping the goods, or termination of the contract against a full refund, if repair and replacement are impossible, if they cannot be carried out within one month of the complaint, or if they cause major inconvenience. Termination of the contract is not available where the lack of conformity is minor.

The consumer also benefits from the guarantee against hidden defects under articles 1641 et seq. of the French Civil Code, for two years from discovery of the defect, within a limit of twenty years from delivery of the goods. This guarantee gives the right either to return of the goods against a refund of the price, or to a reduction in the sale price.

These legal guarantees apply independently of any commercial warranty.

To make a claim: contact@buschcollectibles.com, stating the order reference and attaching photographs of the defect observed. The Seller guarantees the authenticity of each item sold, in conformity with the description on its product page.

Should it be established, on production of a certificate issued by an expert accredited by the Chambre Syndicale Française des Négociants et Experts en Philatélie (CNEP), that an item is not authentic or does not substantially correspond to its description, the sale is terminated automatically. The Seller then refunds the price paid, outbound and return shipping costs, and reasonable expert fees, on production of supporting documents.

This guarantee applies without time limit and benefits the original Buyer. It does not cover differences of opinion as to condition or market value, nor catalogue revisions subsequent to the sale. Any complaint should first be addressed to contact@buschcollectibles.com. A reply is provided within 5 working days.

Consumer Failing an amicable solution, the consumer may use free of charge the mediation service CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice, listed by the CECMC, within one year of their written complaint:

Referral is made online at https://www.cm2c.net, stating the Seller's SIREN number (824 133 839) and attaching proof of the prior written complaint. Mediation is free of charge for the consumer, apart from any representation or expert fees they choose to incur. It is confidential and framed within 90 days of referral. The parties retain in any event the option of bringing the matter before the courts.

Applicable law. These terms are governed by French law. The reference language is French.

Competent jurisdiction.
Consumer In accordance with article 6 of the Rome I Regulation and articles 17 to 19 of the Brussels I bis Regulation, a consumer residing in another Member State retains the benefit of the mandatory protective provisions of the law of their habitual residence. They may bring proceedings, at their choice, before the French courts or those of their place of domicile.
Business Any dispute falls within the exclusive jurisdiction of the courts of the Seller's registered office. Personal data. The processing of personal data is described in the legal notice, which forms an integral part of these terms.

Intellectual property. The purchase of an item does not transfer any rights attached to the photographs and descriptions published by the Seller.

Force majeure. The Seller cannot be held liable for non-performance of its obligations resulting from an event of force majeure within the meaning of article 1218 of the French Civil Code, in particular postal strikes, customs closures, natural disasters or general failure of communication networks.

Partial invalidity. The invalidity of one clause does not affect the validity of the remaining provisions.

Archiving. The contract is concluded in French and archived by the Seller. The Buyer may obtain a copy on simple request.
